Background: Freezing of gait is a common symptom in Parkinson’s disease and can be difficult to treat with dopaminergic medications or with deep brain stimulation. Novel stimulation paradigms have been proposed to address suboptimal responses to conventional DBS programming methods. Burst-cycling deep brain stimulation delivers current in various frequencies of bursts, while maintaining an intra-burst frequency identical to conventional DBS.Objective: To evaluate the safety and tolerability of BCDBS in PD patients with FOG.Methods: Ten PD subjects with STN or GPi DBS (...) and complaints of FOG were recruited for this single center, single blinded within-subject crossover study. For each subject, we compared 4, 10, and 15 Hz BCDBS to conventional DBS during the PD medication-OFF state.Results: There were no serious adverse events with BCDBS. It was feasible and straightforward to program BCDBS in the clinic setting. The benefit was comparable to conventional DBS in measures of FOG, functional mobility and in PD motor symptoms. BCDBS had lower battery consumption when compared to conventional DBS.Conclusions: BCDBS was feasible, safe and well tolerated and it has potential to be a viable future DBS programming strategy. In this paper a method is proposed for empirically determining simultaneity at a distance within the special theory of relativity. It is argued that this method is independent of Einstein's signalling method and provides a basis for denying the conventionality of distant simultaneity.

Robert Jackson examines the work of the German artist Florian Slotawa. Beginning with his first works, “Hotelarbeiten”, Slotawa recomposes and reconfigures the order of ordinary objects – in this case, the furniture of hotel rooms. In reconstructing these rooms in another order without altering these objects in any way, photographing them, and then subsequently restoring them to their previous configuration, the artist reveals the ordinary function of the objects and by withdrawing from their function shows their material and (...) factual character. To elucidate the specificity of Slotawa’s intervention, Jackson critiques Heidegger’s conception of facticity in its exclusive account of Dasein and its being-in-the world, in contrast to the factuality of “things-within-the world.” Drawing on Harman’s extension of finitude beyond Dasein to all things, he encourages us to see Slotawa as engaged in “facticity of things” that is characterized by dispossession, lack of reason, and radical contingency. As Jackson argues, Slotawa is trying to find a way to dwell in a world that has no room or possibility for the given coordinates of dwelling; a world that is a fact without reason. In concluding he explores a reading of Slotawa that explores the intersecting yet radically different approaches to thinking about a speculative realism in the work of Harman and Meillassoux, and their differing attitudes to the finite and the infinite, facticity and factiality, contingency and necessity, without presuming to assume that either of these accounts cover the speculative facticity of things revealed in Slotawa’s work. Multicultural education was attacked by antiracists in Britain in the 1980s. Although it is arguable that not all of the criticisms were valid, the debate raises questions about the efficacy of religious education in countering racism. The paper argues that a lack of analysis of the concepts 'religions' and 'cultures' in British RE has led to a representation of religious traditions which essentialises them, playing down their internal diversity, and which assumes a 'closed' view of cultures. A more flexible approach (...) is suggested, drawing on work in ethnography and other social science disciplines, which might better combine with antiracist stances than earlier approaches. The work of the Warwick Religions and Education Research Unit is introduced briefly as an example of an attempt to address some of the above issues in terms of an integrated approach to theory, the study of religions in the community and the development of religious education curriculum materials. Considering recent re-assessments of Pareto and Mosca, I discuss whether these thinkers’ socio-political orientations contribute to the ‘disfiguration’ of democracy or provide a resource for the renewal of democratic institutions. Femia presents Pareto as being in the “Machiavellian tradition of sceptical liberalism,” revealing the liberal potential of Pareto’s realist political theory. Finocchiaro ameliorates the conservative consequences of Mosca’s thought by reinterpreting him as a ‘democratic elitist,’ who holds a conception of political liberty “as a relationship such that authority flows from (...) the masses to the elites.” Highlighting the significance of internal tensions within each thinker’s work foregrounded by these readings, between the causal primacy of psychic states and the ‘mutual dependence’ of social factors, and between the elite principle and ‘balanced pluralism’, I ask whether the ‘sceptical liberal’ Pareto or the ‘democratic elitist’ Mosca elude Urbinati’s unpolitical, populist and plebiscitarian ‘disfigurations’ of democracy. What follows is a cursory response to Graham Harman’s article “Materialism is Not the Solution.” It seeks to branch out his conception of ‘form’ and more specifically, ‘aesthetic form’ whilst expanding on Harman’s principal objections to the materialist account of change, and how this may challenge the contemporary aesthetic trajectory of relational encounter: particularly Bourriaud’s Relational Aesthetics. Quite generally, Harman’s Object Oriented Ontology might be understood through two chief aesthetic mechanisms; the contingency of counterfactuals complimented with the preliminary development of (...) a nonmodern formalism. The latter is briefly cashed out in a philosophical juxtaposition to Greenberg and Fried’s modernist principles. (shrink)

Macphail’s ‘null hypothesis’, that there are no differences in intelligence, qualitative or quantitative, between non-human vertebrates has been controversial. This controversy can be useful if it encourages interest in acquiring a detailed understanding of how non-human animals express flexible problem-solving capacity (‘intelligence’), but limiting the discussion to vertebrates is too arbitrary. As an example, we focus here on Portia, a spider with an especially intricate predatory strategy and a preference for other spiders as prey. We review research on pre-planned detours, (...) expectancy violation and a capacity to solve confinement problems where, in each of these three contexts, there is experimental evidence of innate cognitive capacities and reliance on internal representation. These cognitive capacities are related to, but not identical to, intelligence. When discussing intelligence, as when discussing cognition, it is more useful to envisage a continuum instead of something that is simply present or not; in other words, a continuum pertaining to flexible problem-solving capacity for ‘intelligence’ and a continuum pertaining to reliance on internal representation for ‘cognition’. When envisaging a continuum pertaining to intelligence, Daniel Dennett’s notion of four Creatures (Darwinian, Skinnerian, Popperian, Gregorian) is of interest, with the distinction between Skinnerian and Popperian Creatures being especially relevant when considering Portia. When we consider these distinctions, a case can be made for Portia being a Popperian Creature. Like Skinnerian Creatures, Popperian Creatures express flexible problem solving capacity, but the manner in which this capacity is expressed by Popperian Creatures is more distinctively cognitive. I defend one way of solving the Impermissibility Problem—that is, the problem that on moralized approaches to coercion, coerciveness and permissibility are mutually exclusive. This brings up intuitive difficulties for cases such as taxation, which seem to be both coercive and permissible. I gloss three popular theories of coercion—the moralized baseline, nonmoralized baseline, and enforcement approaches—and conclude that only the nonmoralized baseline approach clearly solves the problem. However, Robert Nozick’s famous “slave case” raises another serious issue for the nonmoralized (...) baseline approach. So, in order to solve both the slave case and the Impermissibility Problem, I draw on Grant Lamond’s discussion of the coerciveness of law to propose the pro tanto wrong approach. On this approach, coercion is not impermissible simpliciter, but requires some sort of special justification. The pro tanto wrong approach is moralized, but on it, moralization comes in coercion’s need for justification, not in whether it is, in fact, justified. Thus impermissibility is neither necessary nor sufficient for coerciveness, and the Impermissibility Problem is avoided. I conclude that solving the problem in this way is desirable because it preserves a core belief of liberalism: certain acts, including taxation, may be both coercive and permissible. (shrink)

This book addresses three major questions about law and legal systems: (1) What are the defining and organizing forms of legal institutions, legal rules, interpretive methodologies, and other legal phenomena? (2) How does frontal and systematic focus on these forms advance understanding of such phenomena? (3) What credit should the functions of forms have when such phenomena serve policy and related purposes, rule of law values, and fundamental political values such as democracy, liberty, and justice? My paper addresses a topic--the implications of Rawls's justice as fairness for affirmative action--that has received remarkably little attention from Rawls's major interpreters. The only extended treatments of it that are in print are over a quarter-century old, and they bear scarcely any relationship to Rawls's own nonideal theorizing. Following Christine Korsgaard's lead, I work through the implications of Rawls's nonideal theory and show what it entails for affirmative action: viz. that under nonideal conditions, aggressive forms of formal equality of (...) opportunity (e.g., sensitivity training, outreach efforts, external monitoring and enforcement) and compensating support (e.g., special fellowship programs, childcare facilities, mentoring, co-op opportunities, etc.) can be justified, but that "hard" and even "soft" quotas are difficult to defend under any conditions. I conclude the paper by exploring the implications of these surprising results for contemporary liberalism more broadly and for constitutional law and public policy. (shrink)

Contemporary republicanism is characterized by three main ideas: free persons, who are not subject to the arbitrary power of others; free states, which try to protect their citizens from such power without exercising it themselves; and vigilant citizenship, as a means to limit states to their protective role. This book advances an economic model of such republicanism that is ideologically centre-left. It demands an exit-oriented state interventionism, one that would require an activist government to enhance competition and resource exit from (...) dominating relationships within markets of all types, be they marital, labour, or residential. The substantial intervention and redistribution necessitated by such an approach make it leftist, while its tendency to work with rather than against the grain of markets makes it centrist. It is, in short, a contribution to progressive republican political thought, but one that is less social-democratic than market-democratic in character. (shrink)

The Knowledge Argument of Frank Jackson has not persuaded physicalists, but their replies have not dispelled the intuition that someone raised in a black and white environment gains genuinely new knowledge when she sees colors for the first time. In what follows, we propose an explanation of this particular kind of knowledge gain that displays it as genuinely new, but orthogonal to both physicalism and phenomenology. We argue that Mary’s case is an instance of a common phenomenon in which (...) something new is learned as the result of exploiting representational resources that were not previously exploited, and that this results in gaining genuinely new information. Frank Jackson’s book brings a central metaphilosophical issue into sharp focus, and it is this general issue—the role of conceptual analysis and the thesis that it is a source of a priori knowledge—to which I will direct my comments. I have no problem with the activity that Jackson calls “conceptual analysis.” My worry is about the epistemological status claimed for this activity. I confess that I have only a dim idea of what a priori knowledge might be, but (...) I am inclined to be skeptical about whether the conclusions of philosophical inquiry are, in any reasonable sense, knowable a priori. (shrink)

The recent literature on mental causation has not been kind to nonreductive, materialist functionalism (‘functionalism’, hereafter, except where that term is otherwise qualified). The exclusion problem2 has done much of the damage, but the epiphenomenalist threat has taken other forms. Functionalism also faces what I will call the ‘problem of metaphysically necessary effects’ (Block, 1990, pp. 157-60, Antony and Levine, 1997, pp. 91-92, Pereboom, 2002, p. 515, Millikan, 1999, p. 47, Jackson, 1998, pp. 660-61). Functionalist mental properties are individuated (...) partly by their relation to the very effects those properties’ instantiations are thought to cause. Consequently, functionalist causal generalizations would seem to have the following problematical structure: The state of being, among other things, a cause of e (under such-andsuch conditions) causes e (under those conditions).3 The connection asserted lacks the contingency one would expect of a causal generalization. Mental states of the kind in question are, by metaphysical necessity, causes of e; any state that does not cause e is thereby a different kind of state. Yet, a mental state’s being the sort of state it is must play some causal role if functionalism is to account for mental causation.4 In what follows, I first articulate more fully the problem of metaphysically necessary effects. I then criticize three functionalist attempts to solve the problem directly. Given the failure of functionalist efforts to meet the problem head-on, I consider less direct strategies: these involve formulating functionalism or its causal claims in such a way that they appear not to generate the problem of metaphysically necessary effects. I argue against these indirect solutions, in each case concluding either that the problem still arises or that avoiding it requires the adoption of an unorthodox form of functionalism (itself a surprising result). The republican tradition has long been ambivalent about markets and commercial society more generally: from the contrasting positions of Rousseau and Smith in the eighteenth century to recent neorepublican debates about capitalism, republicans have staked out diverse positions on fundamental issues of political economy. Rather than offering a systematic historical survey of these discussions, this chapter will instead focus on the leading neo-republican theory—that of Philip Pettit—and consider its implications for market society. As I will argue, Pettit’s theory is even (...) friendlier to markets than most have believed: far from condemning commercial society, his theory recognizes that competitive markets and their institutional preconditions are an alternative means to limit arbitrary power across the domestic, economic, and even political spheres. While most republican theorists have focused on political means to limit such power—including both constitutional means (e.g., separation of powers, judicial review, the rule of law, federalism) and participatory ones (democratic elections and oversight)—I will examine here an economic model of republicanism that can complement, substitute for, and at times displace the standard political model. Whether we look at spousal markets, labor markets, or residential markets within federal systems, state policies that heighten competition among their participants and resource exit from abusive relationships within them can advance freedom as non-domination as effectively or even more effectively than social-democratic approaches that have recently gained enthusiasts among republicans. These conclusions suggest that democracy, be it social or political, is just one means among others for restraining arbitrary power and is consequently less central to (certain versions of) republicanism than we may have expected. So long as they counteract domination, economic inroads into notionally democratic territory are no more worrisome than constitutional ones. (shrink)

In the writings of scientists we find claim to the effect that we can observe items such as pulsars, gravity waves, quarks, electrons, etc. An epistemological theory, originally developed by Dretske and modified by Jackson, is used to give an account of such claims and the extent to which they may be deemed correct. The theory eschews talk of the theory-ladenness of observation while giving an account of how our observation reports may evolve with growth in scientific knowledge. Robert Nozick's The Examined Life is an attempt at metaphysically speculative and humanly significant philosophy. It is a failed attempt. It fails because it is made within the constricted intellectual horizons of Anglo?American analytic philosophy, which leads Nozick implicitly to identify metaphysical speculation with tautology and extravagant absurdity and to identify value significance with aesthetic or emotional stimulation. Nozick's ?meditation?; on ?The Zigzag of Politics?; is singled out for special attention. It is argued that Nozick's transformation from libertarian to (...) liberal welfare?statist is not a departure from, but a radicalization and affirmation of the egalitarian individualism and moral and political aestheticism of his Anarchy, State, and Utopia. Through an analysis of key themes in Heidegger's work, the book challenges the traditional theological appropriation of Heidegger and the usual characterizations of religious thinking in terms of faith or belief in, or experience of, some ultimate reality. Heidegger, it is argued, offers a unique approach to a variety of issues and problems in contemporary religious thought and philosophy of religion that results in understanding religious thinking as a resolute openness to the holiness and meaningfulness of the world.

In Home Building & Loan Assn. v. Blaisdell, the Supreme Court upheld the constitutionality of the Minnesota Mortgage Moratorium Act. Under the terms of the Act---one of the many pieces of moratory legislation enacted due to the Great Depression---mortgagors who found themselves unable to make their payments could turn to the state courts for an alteration of their payment schedule. It is clear that if there ever was a state of affairs in which one could justify the imposition of debtor (...) relief, the circumstances in Minnesota during the early 1930s would have filled the bill. By most accounts, the Act was justifiable from a policy perspective. ;Nevertheless, the outcome did not please everyone. The question before the Court was whether the proceedings authorized by the Act violated the contracts clause of the Constitution. Article 1, §10 provides that "No State...pass any...law impairing the Obligation of Contracts." The Act did impair the obligation of mortgage contracts. Furthermore, the Act was exactly the kind of debtor relief legislation that the contracts clause meant to forbid. The basic premise underlying the majority opinion was that a constitutional provision should be interpreted both in the context of the entire Constitution and in the context of the social situation confronting the Court. According to the dissent, the framing of the Constitution fixed the meaning of a provision for all cases arising across time. The two approaches represent two extremes in constitutional interpretation. However, the basic agreement is over how the Constitution should evolve. The basic disagreement concerns the problem of constitutional change. ;In a recent work, Robert Lipkin radically rethinks modern constitutional jurisprudence, challenging the received view of constitutional change. His theory of "constitutional revolutions" implies that conventionalism, coherentism, pragmatism, and naturalism all fall short as the best theory of constitutional change. In addition to offering a critique of Lipkin's theory, the present work conducts an independent investigation the theories Lipkin rejects. Such an investigation will not only help ascertain the legitimacy of Lipkin's theory of constitutional revolutions in particular, but of radical constitutional change in general. (shrink)

Commercial republicanism is the idea that a properly-structured commercial society can serve the republican end of minimizing the domination of citizens by states (imperium) and of citizens by other citizens (dominium). Much has been written about this idea in the last half-century, including analyses of individual commercial republicans (e.g., Adam Smith and Immanuel Kant) as well as discussions of national traditions of the same (e.g., in America, Britain, France, the Netherlands, and Italy). In this chapter, I review five kinds of (...) arguments that have been historically offered for how commercial society so understood advances the republican ideal of non-domination: first, by simply realizing non-dominating relationships in the marketplace itself (Instantiation); second, by encouraging the growth of a wide middle class that can offer a counterweight to other, dominating classes (Internal Check-and-Balance); third, by increasing the wealth and power of republics vis-à-vis other, dominating states in the international arena (External Check-and-Balance); fourth, by helpfully nurturing bourgeois-civic virtues in republican citizens (Cultivating Virtue); and finally, by transforming dangerous passions into more readily regulable, even socially beneficial material interests (Sublimating Vice). I end the chapter by briefly considering commercial republicanism’s prospects as a continuing research program. (shrink)

Many philosophical naturalists eschew analysis in favor of discovering metaphysical truths from the a posteriori, contending that analysis does not lead to philosophical insight. A countercurrent to this approach seeks to reconcile a certain account of conceptual analysis with philosophical naturalism; prominent and influential proponents of this methodology include the late David Lewis, Frank Jackson, Michael Smith, Philip Pettit, and David Armstrong. Naturalistic analysis is a tool for locating in the scientifically given world objects and properties we quantify over (...) in everyday discourse. This collection gathers work from a range of prominent philosophers who are working within this tradition, offering important new work as well as critical evaluations of the methodology. Frank Jackson argued, in an astronomically frequently cited paper on 'Epiphenomenal qualia '[Jackson 1982 that materialism must be mistaken. His argument is called the knowledge argument. Over the years since he published that paper, he gradually came to the conviction that the conclusion of the knowledge argument must be mistaken. Yet he long remained totally unconvinced by any of the very numerous published attempts to explain where his knowledge argument had gone astray. Eventually, Jackson did publish a (...) diagnosis of the reasons why, he now thinks, his knowledge argument against materialism fails to prove the falsity of materialism [Jackson 2005. He argues that you can block the knowledge argument against materialism - but only if you tie yourself to a dubious doctrine called representationalism. We argue that the knowledge argument fails as a refutation of either representational or nonrepresentational materialism. It does, however, furnish both materialists and dualists with a successful argument for the existence of distinctively first-person modes of acquaintance with mental states.
